Supreme Economic Court dismissed the complaints of the Ministry of Transport and Communications, leaving unchanged the previous decisions of the courts, finally confirming the legitimacy of demands raised by the Antimonopoly Committee of Ukraine to the Ministry of Transport and Communications to stop obstructing the implementation of dredging works to “NIBULON”. In particular, on the 18th of January, 2011 Supreme Economic Court of Ukraine rejected the cassation complaints of the Ministry of Transport and Communications and the State Enterprise “Mykolayiv Commercial Sea Port” and upheld the decision of the Economic Court of Kyiv and the Kyiv Economic Court of Appeal. We want you to recall that on the 18th of October, 2010 Kyiv Economic Court of Appeal rejected the appeal for the abolition of the Ministry of Transport and Communications decision and upheld the decision of the Economic Court of Kyiv d/d the 19th of July 2010, which recognized the legitimacy of the decision of the Antimonopoly Committee of Ukraine d/d 05.10.2010. As it was previously reported, in March 2010 the Antimonopoly Committee bound the Ministry of Transport and Communications to cancel the decision, which denied dredging works performance to “NIBULON” baselessly, re-examining materials available, deciding on their agreement. Also – to refrain in future from unreasonable obstacles creating during the performance of dredging works by “NIBULON”.
