Mykolayiv customs illegally delays custom registration of cargo and export operations of “NIBULON”

Since the 16th of October 2010 Mykolayiv customscommits unlawful acts, which reside inunreasonable delaying of custom registration of cargo and export operations with barley grain and corn of Ukrainian origin at the transshipment terminal of “NIBULON” (Mykolayiv). As of the 19th of October 4 vessels are awaiting consent documents at the berth of the transshipment terminal of “NIBULON” and on the raid of Mykolayiv Commercial Sea Port, they are under contracts to deliver 40 thousand tons of corn to Egypt; 31,3 thousand tons of barley to Saudi Arabia and 5,7 thousand tons of wheat to Georgia. Employees of our company have often turned to the customs service, but have not received any response. Thus, the documents as to custom registration of 5,7 tons of wheat loaded in the «LYON» vessel, that were given by our employees to the department of customs registration № 3 of Mykolayiv customs on 17.10.2010, are  unreasonably ignored by the customs authorities and are not reviewed. On 17.10.2010 loading of «SVYATOY PANTELEYMON» vessel was stopped by unjustified order of the customs officers, causing the fact that about 1 thousand tons of barley were underloaded on the vessel. The documents as to custom registration of 30,3 tons of barley loaded in the «SVYATOY PANTELEYMON» vessel, that were given to the department of customs registration № 3 of Mykolayiv customs on 18.10.2010, are  also unreasonably ignored by the customs authorities and are not reviewed. Mykolayiv Regional State Administration and personally the Prime Minister of Ukraine Mykola Azarov are now informed about the situation and the progress of correspondence of “NIBULON” and Mykolayiv customs. Customs officials unreasonably refused and continue to refuse to carry out customs procedures required by law, for cargo as well as for vehicles, also they delay processing of documents intentionally without any explanation, verbally hinting till 19.10.10 at decree of the Cabinet of Ministers of Ukraine dd 04.10.2010 № 938 “On the setting of quotas for certain agricultural products, export of which has to be licensed until the 31st of December 2010, and approval of the order of issuance of export licenses for certain types of agricultural production and allocation of quotas”, which as of 18.10.2010 has not come into force. Thus, 4 foreign cargo vessels in particular, «PRINCESS JUANA K», «LEVANTES», «SVYATOY PANTELEYMON» and «LYON» are currently forced outage because of the illegal acts of Mykolayiv customs, which causes considerable losses to our company as a payment of forced outage, default on obligations as to the concluded foreign economic transactions and currency earnings deficiency from fulfillment of export contracts for the supply of nearly 80 thousand tons of Ukrainian origin grain. As of 20.10.2010, 532 wagons with wheat and corn are travelling to the transshipment terminal of “NIBULON”. 272 trucks with moisture corn which requires drying are in anticipation of unloading. Some drivers are already queuing for more than three days. Today elevator of the company Ltd. “AC Vradiyivskyy” (Mykolayiv region) has completely stopped accepting corn. Elevators of “Smotrych” (Khmel’nyts’kyy region), “Zolotonis’ka”, “Vitove” (Cherkasy region), “Reshetylivs’ka” (Poltava region) branches and Ltd. “Kolosivs’kyy elevator” (Mykolayiv region) are able to continue acceptance of corn only for a few days despite harvesting is still ongoing. Soon elevators of “Kamyanka-Dniprovs’ka”, “Gradyz’k”, “Globyns’ka”, “Romodan” branches will have to stop acceptance of grain crops. Thus, our company is unable to dry and place about 50 000 tons of own harvest corn on linear elevators. For reason given above we have to stop purchase of corn and other crops and, unfortunately, to stop picking corn from the fields of our company. We believe that other companies-producers have the same situation or even worse. On the whole within the country as of 19.10.2010, only 81% of corn is picked and 2 million tons still are to be picked. These are the volumes that Ukraine could potentially lose. On the 17th of October «MEVLANA» vessel arrived in the roads of “Yuzhnyy” pilot anchorage, 19 thousand tons of wheat will be loaded on it, and on the 20th of October «BALIKESIR» vessel arrived – for the loading of 16 thousand tons of wheat. Motor vessels «HUZUR I» and «GEM I» at 15 thousand tons and 29 thousand tons of corn, respectively, are arriving in the roads of “Yuzhnyy” pilot anchorage on the 21st and 22nd of October. The above mentioned actions of the customs do not comply withlegally enshrined the constitutional basisof law in economic sphere and violate the rights and interests of our company. We understand that this is done without consent of the President of Ukraine Viktor Yanukovych and the Prime Minister of Ukraine Mykola Azarov and appeal to the state leadership with a request to consider raised issue urgently and take necessary measures to stop illegal actions of Mykolayiv customs as to our company, instructing to complete custom registration of cargo and export operations as it is prescribed by law.

Андрій Вадатурський став генеральним директором «НІБУЛОНу» після понад 15 років роботи в компанії — в липні 2022 року.

Він прийняв цю посаду після трагічної загибелі свого батька та засновника «НІБУЛОНу» Олексія Вадатурського разом із матір’ю Раїсою Вадатурською під час російського ракетного удару по їхньому дому в Миколаєві.

З 2014 до 2019 рік був народним депутатом України від одномандатного округу в Миколаївській області та членом Комітету з питань аграрної політики. У 2017 році створив і очолив велику міжпартійну групу, яка виступала за розвиток українських річок як транспортного засобу.  

Має ступінь магістра електротехніки Українського державного морського технічного університету та ступінь магістра економіки промисловості Лондонської школи економіки. У 2009 році за вагомий внесок у розвиток агропромислового комплексу України був нагороджений Президентом України, йому присвоєно звання «Заслужений працівник сільського господарства».

Одружений, має трьох дітей.
