On the 27th of January, 2011 the Commercial Court of Kyiv denied the claim of “Delta-pilot” to the Antimonopoly Committee of Ukraine to cancel the decision, by which the Committee adjudged violations of antitrust legislation during the obstruction of pilotage of «PREVENTER» vessel, ascertaining the fact of abuse of monopoly on the part of “Delta-pilot”. We would like to remind you that in October 2009 cargo vessel «PREVENTER» arrived flying flag of Panama for loading of barley of Ukrainian origin in the amount of about 65 thousand tons to the berth of the transshipment terminal of “NIBULON” to the Ukraine’s territorial waters. Within 141 days ship journey to the berth of “NIBULON” was blocked by far-fetched reasons. On the 5th of March, 2010 the vessel «PREVENTER» called to the berth of “NIBULON”, where it was loaded with 37,7 thousand tons of barley and moved forth from the terminal in the direction of the raid of port Ochakiv to finish loading. As it was previously reported, on the 21st of September, 2010 the Antimonopoly Committee of Ukraine has fined the State Enterprise “Mykolayiv Commercial Sea Port” and the State Enterprise “Delta-pilot” UAH 600 thousand and UAH 30 thousand respectively, for abuse of monopoly provision of vessel escort and implementation of navigation safety. The Committee also acknowledged the commitment of anticompetitive practices of the State Enterprise “Mykolayiv Commercial Sea Port” Ryabchykov P.S., and violations of the Ministry of Transport and Communications, which was to legitimize actions of captain.
